High Court Decision About RTET below 55 % in Third Grade Teacher Recruitment.
Honourable High Court Jaipur has passed an decision in the Case of Vikas Kumar Agrawal and others v/s State of Rajasthan. Mr. Vighyan Shah was the advocate for applicant. The decision is that :-
1. The Candidates belonging to any category, who secured marks below 55 % in RTET, are not eligible for appointment as a Third Grade Teacher. The Court ordered to the Rajasthan Govt not to appoint such candidates and issue a fresh Selection List withing three months.

Honourable High Court Jaipur has passed an decision in the Case of Vikas Kumar Agrawal and others v/s State of Rajasthan. Mr. Vighyan Shah was the advocate for applicant. The decision is that :-
The basic point in this matter is that the
(A) NCTE, New Delhi published a Notification dated 23 August, 2010 and included provisions that (i) Only TET passed candidates with minimum 60 % marks can be posted as Third Grade Teacher, (ii) The State Govt may allow relaxation to various reserve categories for to be declared passed in TET.
(B) NCTE, New Delhi published an other Notification dated 29 July, 2011 and amended Notification dated 23 August, 2012 through it that various reserve categories may be allowed maximum relaxation up to 5 % marks in TET.
(C) The Govt of Rajasthan and Board of Secondary Education, Rajasthan, Ajmer allowed 5, 10, 15, 20, 24 % relaxation to various reserve categories in RTET 2011. On the other side Pujab, Haryana, Gujrat, Uttar Pradesh, Aasam and many other states allowed relaxation maximum up to 5 %.
(D) Approx 10000 Such candidates who secured below 55 % in RTET 2011 selected as a third grade teacher in recent recruitment by Raj Panchayati Raj Depertment.
2. Any candidate who have availed the reservation benefit after the selection procedure started, can not be selection against Open/ General categories seats despite high scoring. Thus the candidates belonging to any reserve category who have availed any type of relaxation during a particular selection procedure can not be selected open/ general category seats despite they have secured higher marks than the cut off marks for General/ Open category.
